Warranty was 8 years/82K miles for wastegates on N54 cars through MY10. They are vacuum controlled. Mine began to rattle bad somewhere around 90K miles but the turbos continued to operate without issues until 140K miles. Replaced the turbos ~10K miles ago so all is well now. True wastegate rattle on a N54 is unbearable for most people as it sounds like a coffee can half full of nails is violently shaking every time you let off the throttle.
Are you running the stock tune? Do you get a CEL w. the TSP DP? Considering it, but I need to avoid a code to pass inspection.
Even if you are running a stock tune you will not get a CEL with the tsp dp. It has a 400 cell GESI cat, but @Two Step Performance may be able to weigh in more, they are certainly more in tune with the details than I.

Agreed- although now I do think I was going to end up doing an exhaust upgrade anyway. There is comfort in knowing I don't suffer alone, but this also means that if it's this prevalent, there's a market for someone to come up with a solution for it.
